Terms and conditions Use of the website rcefoto.com and purchases made through this channel are governed by these General Terms and Conditions of Sale and Use of Services, accessible via the "Terms and Conditions" link, and are considered accepted by users when they contact our stores by phone or email. RCE Foto is a network of independent stores that operate independently; the items for sale on the rcefoto.com website are second-hand. The rcefoto.com website is owned by RCE PD Srl and is made available to individual affiliated stores to facilitate the display and sale of available items to the public. RCE PD Srl does not guarantee the accuracy of information published on the site by affiliated stores and disclaims any liability for potential problems, damages, or risks that users may encounter while using the site. By accessing the site and interacting with its functions, the user declares acceptance that all matters related to the use of the information and e-commerce services offered by the website owner are governed by Italian law and subject to the exclusive jurisdiction of the Court of Padua. GENERAL TERMS For the purposes of these terms, unless otherwise specified, the following definitions apply: RCE Foto Store: the individual store, in any form, that is part of the RCE Foto network. Seller: a private individual or a company that has sold one or more items to an affiliate. Buyer: the customer (individual or legal entity) who purchases one or more second-hand goods sold by the Store. TERMS APPLICABLE TO THE RCE FOTO AFFILIATE By using the rcefoto.com website to offer items for sale to the public, the Affiliate declares that they fully apply all protocols and provisions contained in the agreement in order to guarantee the best possible service to their customers. TERMS APPLICABLE TO THE BUYER WARRANTY The Buyer acknowledges and accepts that the purchased items are second-hand. The RCE Foto Store independently decides to apply and be responsible for the warranty starting from 6 months, as communicated in each listing on rcefoto.com and on portals such as subito.it, Leboncoin, Willhaben, Ebay Kleinanzeigen, Wallapop, Allegro, Skelbiu, etc. Any item found to be defective within the warranty period must be sent or brought to the store where it was purchased. PRICES, PHOTOS, DESCRIPTIONS The sales prices of products shown on the site include VAT and taxes. All photographs and descriptions belong to the actual products for sale. PRODUCT AVAILABILITY Since the website’s assortment is linked to what is available in each store, an order request (non-binding) on the site may coincide with a simultaneous in-store purchase: therefore, the store reserves the right to confirm the actual availability of the reserved items. Used products are unique and have very specific features: while we try to respond as quickly as possible to each request, priority is always given to phone calls. If the order request cannot be fulfilled as requested, the store will promptly inform the Buyer. ORDER CANCELLATION Once the order has been placed, we will send an email with the summary and order confirmation. If the order has been placed and paid for but the Buyer still wishes to cancel before shipping, it will be necessary to quickly call the store, explain the request, and provide contact details. The amount paid will be refunded by bank transfer. Refunds for cancellations will be made within a maximum of 7 days from the refund request date. TAXES ON THE SALE OF USED GOODS The margin scheme is the VAT regime applicable to the sale of used goods (the profit margin VAT scheme provided for by Articles 36 et seq. of Decree Law no. 41/1995, converted into Law no. 85/1995). The possibility of recovering any taxes depends on the case; for more details, consult your tax advisor. PAYMENTS The store will inform the Buyer by phone or email of the shipping costs and the payment deadline before the Buyer completes the order. Payments can be made electronically via Credit Card, Bank Transfer, or financing. Payment is considered made when the amount due has been irrevocably credited to the Store according to the agreed terms. As the items are unique, we decline any responsibility if the Buyer makes payment without waiting for the store’s availability notification or after the indicated deadline. RIGHT OF WITHDRAWAL Returns are not accepted for in-store purchases.The Store recognizes the Buyer’s right of withdrawal only for online purchases, in accordance with applicable law. This right may be exercised by sending a registered letter directly to the store where the purchase was made within 14 days of receiving the goods, after filling out the withdrawal form. The Product must be returned in its original packaging (if present), complete with all included accessories, and in the exact same condition as when it was received. For cameras, only those with the same number of shutter actuations declared in the listing will be accepted. The integrity of the returned product is an essential condition for exercising the right of withdrawal. Damaged returns will not be accepted. Likewise, items damaged by detergents/cleaning additives (e.g., for screens) or mishandling will not be accepted. The risks and costs of return shipping are entirely at your expense. The withdrawal form must be included in the package along with a copy of the invoice. The communication must include the IBAN code to which the customer wishes the refund to be made. In the event of withdrawal, the Buyer will, at their own risk and expense, return the purchased products, intact and in the condition in which they were shipped (including packaging), by express courier to the Store within 14 days of exercising the right or, if later, from the delivery of the goods already shipped. Each Store reserves the right not to accept products showing signs of damage, wear, or contamination not already stated in the product’s technical sheet at the time of sale. The Store undertakes to make the refund within 7 days of receiving the registered letter and the intact goods, net of the shipping costs borne by the Store. Note: The right of withdrawal is reserved for private consumers and therefore cannot be exercised if the Buyer is a VAT-registered business and the purchase is made for commercial purposes with a VAT number. Products must be returned intact, in normal condition, in their original packaging, and complete with all accessories, user manuals, and everything originally contained in the package. In the case of returns or cancellations, only the initial shipping costs will be deducted. EXCHANGE OR SALE If the transaction is an exchange or a sale, customers are asked to provide a detailed description of the item’s condition. If, upon receipt, the description does not match, a second assessment will be carried out and the customer may accept a revised evaluation or request the return. SHIPPING The store undertakes to ship purchased items within 1 business day of receiving payment and cannot be held responsible for delays caused by the chosen couriers. Upon receiving the package, always check the integrity and condition of the packaging. In case of damage or tampering, it is possible to accept the delivery “with reservation.” Only in this case will the store be liable for any damage caused during transport, limited to the amount paid. All storage costs charged by the courier, if delivery is impossible due to the recipient’s unavailability, are borne by the Buyer. Items shipped to BRT Fermopoints remain stored for 7 days; afterwards, they are returned to the sending stores, which reserve the right to charge the customer the costs incurred. Standard shipping rates are available on the shipping page, net of ongoing promotions. Even in the case of promotions, for low-value purchases, the store reserves the right to charge a shipping contribution. IN-STORE PICKUP If the customer selects direct pickup as the delivery method, it must take place within 7 days of receiving payment. JURISDICTION All disputes relating to the validity or performance of contracts concluded via this website and the interpretation of these General Terms and Conditions, which may arise between the Store and the Buyer, shall be submitted exclusively to the court having jurisdiction over the store’s registered office.
